Point Service Terms

These terms govern the point service for members of BETA Climbing Gym (operated by Morasis Inc.).

Article 1 (Definitions)

(1) "The Gym" refers to BETA Climbing Gym operated by Morasis Inc.

(2) "Member" refers to a person who has agreed to the terms of use of BETA Climbing Gym, registered as a member, and received a member ID.

(3) "This Service" refers to the point service provided by the Gym to members.

Article 2 (Overview of Point Service)

This service allows the Gym to award points to members, and members can use these points according to the methods specified by the Gym.

Article 3 (Point Award and Cancellation)

1. Points will be awarded when a member visits the Gym and makes payment for facility use.

Even if payment has been made in advance through a free pass or coupon book, points will be awarded upon facility use.

2. The number of points awarded can be changed at the Gym's discretion.

3. Points will accumulate unless conditions for expiration are met.

4. In the following cases, points may not be awarded or may be cancelled:

  • (1) If service use is cancelled by the member or at the Gym's discretion
  • (2) If points were awarded fraudulently
  • (3) If someone other than the member uses the Gym by impersonation
  • (4) If the member has withdrawn from membership
  • (5) If the Gym awarded points in error

Article 4 (Point Expiration)

Points will expire in full under the following conditions:

  • (1) If one year passes between the last point award (last visit date) and the next visit
  • (2) If the member withdraws from the Gym
  • (3) If points were used fraudulently
  • (4) If the member engages in prohibited acts under Article 8

Article 5 (Point Usage)

1. Members can use points according to methods specified by the Gym.

2. When a member uses points, the number of points used will be deducted from the accumulated point balance.

3. Point usage methods will be separately announced by the Gym.

4. Points cannot be exchanged for cash equivalents.

Article 6 (Point Inquiry)

Members can check their points through the "BETA Pass" smartphone membership app provided by the Gym.

If not using "BETA Pass", members can inquire with Gym staff to check their points.

Article 7 (Personal Information Presentation)

When the Gym deems it necessary, such as when there is no signature on the card, when reissuing a card due to loss or damage, when changing to the "BETA Pass" smartphone membership app, when changing registered name/address, etc., to prevent impersonation by third parties and from a personal information protection perspective, we may request verification of documents such as a driver's license that can confirm the member's identity.

Article 8 (Prohibited Acts)

1. When using this service, members shall not engage in the following acts:

  • (1) Acts violating these terms
  • (2) Acts that harm the rights, interests, or reputation of the Gym, other members, or third parties
  • (3) Acts using this service for purposes or methods other than those specified in these terms
  • (4) Acts of registering for this service using a third party's member ID
  • (5) Acts of transferring, lending, or allowing third parties to use the member ID
  • (6) Acts that violate laws or public order and morals, or acts that may do so
  • (7) Other acts that the Gym prohibits or deems inappropriate

2. If the Gym determines that a member has engaged in any of the acts listed in the preceding paragraph, without prior notice, the Gym may take measures such as temporarily suspending points, deleting registration, or suspending use of this service, and the Gym shall not be liable for any damage incurred by the member as a result.

Article 9 (Service Termination, Changes, Interruption, and Suspension)

1. Without prior notice to members, the Gym may change the content of this service or the conditions for providing this service (including abolishing points, stopping point awards, or changing award rates), and may terminate all or part of this service. Members agree to this in advance.

2. If any of the following events occur, the Gym may interrupt or suspend all or part of this service without prior notice to members, and members agree to this in advance:

  • (1) When work such as relocation, maintenance, inspection, or construction of its facilities occurs
  • (2) When failures occur in communication lines, computers, or other systems operating this service
  • (3) When it is unavoidable to protect the interests of the Gym, members, or third parties
  • (4) When natural disasters, power outages, or other force majeure events occur
  • (5) When interrupting or suspending this service based on these terms

3. The Gym shall not be liable for any disadvantages or damages incurred by users due to interruption or suspension in the preceding paragraph.

Article 10 (Disclaimer)

1. The Gym shall not be liable for any disadvantages or damages incurred by members in connection with this service, including damages caused by natural disasters, system interruptions, delays, suspensions, data loss, obstacles in point usage, or unauthorized access to data due to failures in communication lines or computers.

2. The Gym shall not be liable for any damages suffered by members due to the member's own responsibility.

3. While the Gym makes every effort to prevent fraud such as impersonation, the Gym shall not be liable if fraud occurs that could not be foreseen or uses unknown technology.

Article 11 (Amendment of Terms)

1. Without prior notice to members, the Gym may amend all or part of these terms, and members agree to this in advance.

2. Amendments to these terms shall take effect when the Gym posts the amended terms on the BETA Climbing Gym website, and when a member first uses this service after the amendment, they shall be deemed to have agreed to the amended terms.

Article 12 (Governing Law and Agreed Jurisdiction Court)

These terms shall be interpreted in accordance with Japanese law, and in the event that litigation becomes necessary regarding these terms, the Tokyo District Court shall be the exclusive agreed jurisdiction court of first instance.
